1.  Website


1.1.  By using this website and engaging the Diamends team you agree to be bound by the terms and conditions below. Please read through these terms and conditions carefully each time you visit this site as these are updated regularly.

1.2.  Prices displayed on this website are indicative and final pricing depends on various elements such as ring size, materials used, specifications of the stone and the exchange rate.

1.3.  All content on this website (including but not limited to pictures, text, video and graphics) may not be copied, reproduced, distributed, republished, downloaded, displayed or transmitted in any form or by any means without the written consent of Diamends.

2.  Privacy and Personal Information


2.1.  Diamends respects your privacy and will treat your personal information in accordance with all the relevant laws in South Africa.

2.2. Your personal information may be collected when using this website or when you submit a request to be contacted. Personal information provided to us will be kept strictly confidential and will not be sold, disclosed to third parties or be reused without your permission.

2.3.  Your collected personal information will only be used in the following ways:

      2.3.1. To fulfill our obligation to you in the ordinary course of our business.

      2.3.2. To administer a contest, promotion, survey or another site feature.

      2.3.3. To improve customer service.

2.4.  Your personal information will never be shared with unrelated third parties or third parties with who we do not have a business relation with unless you have provided consent.

2.5.  Your personal information may be disclosed for the following reasons:

     2.5.1. To comply with the law or with a legal process.

     2.5.2. To protect Diamends and its property against misuse or fraudulent activity.

2.6.  You have a right to request a copy of the personal information we hold about you. This request must be in writing and a fee will be payable to provide this information.

3.   Ordering


3.1.  Our consultants will provide you with a quotation during a consultation and all quotations are valid for 7 (seven) days.

3.2.  If the specifications of the diamond cannot be met due to availability, the Diamends agent will provide you with a new quotation based on available diamonds as close to your specifications as possible.

3.3.  Manufacturing will only commence once the full payment has been received.

3.4.  Diamends reserve the right to cancel or deny orders.

3.5.  If a valuation certificate is required to arrange insurance prior to delivery, please request a valuation certificate from the Diamends agent during the consultation.

4.   Payment


4.1.  Precious and semi-precious stones are priced in United States Dollars and the price in South African Rand is therefore dependent on the exchange rate.

4.2. Whilst Diamends endeavour to provide an accurate quotation the daily exchange rate fluctuation could affect the invoice cost of your ordered goods. Diamends reserves the right to adjust the quotation exchange rate until such time as payment has been received.

4.3.  Unfortunately Credit Cards are not accepted and payments must be made by EFT. Payment is considered to be completed when funds reflect and are cleared in the Diamends account.

5.   Delivery


5.1. Only when your diamond exceed 0.3 carat will your delivery be accompanied with a certificate from a diamond grading laboratory detailing the specifications of your diamond.

5.2. Delivery of local orders will be by hand or per courier as agreed between yourself and the Diamends agent.

5.3.  We endeavour to deliver all orders within 2 (two) weeks of receiving payment.

5.4. Risk of ownership transfers to you on delivery provided payment has been received in full. For clarity, goods are deemed to be delivered when delivered as agreed between you and the Diamends agent, and not when you receive the goods personally.

5.5. On delivery you must examine the item to ensure the item delivered is the item ordered and that the item is to your satisfaction. If you are not satisfied with the item you must not take delivery.

6.   Returns and Refunds


6.1.  Diamends has a back to back warranty against defects in manufacturing and workmanship with our manufacturer. A defect caused by excessive wear, abuse of items and physical damage, whether accidental or not, is excluded.

6.2.  Products altered or tampered with by any means cannot be returned under the workmanship guarantee.

6.3.  In the event of a legitimate defect, Diamends will engage the manufacturer and have the defect remedied on behalf of the client.

6.4.  Items are made to order and therefore refunds are unfortunately not possible. This is in line with the Consumer Protection Act No. 68 of 2008 defined as special ordered goods.

6.5.  Under no circumstances are delivery cost or courier fees refundable.

7.   Rework


7.1.  Any existing jewellery can be evaluated for rework to change the diamond(s) or to make minor alterations. Only additional material and labour will be charged.

8.  Disclaimer and Limitation of Liability


8.1.  Although we have taken care to ensure that the content on this site is accurate, we do not guarantee, represent or warrant that your use of this site will be uninterrupted, timely or error-free.

8.2.  Diamends and our affiliates, shareholders, directors, agents, consultants or employees will not be liable for any damages whatsoever relating to your use of this site or the online services or the information contained on this site or your inability to use this site or the online services. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

8.3.  The use of this website and its contents is forbidden in those places where the law does not allow this disclaimer to take full effect.
